By accessing or using the Yayika platform (yayika.com) ("Platform"), you hereby accept these Terms and Conditions. If you do not agree with any of these terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you ("User") and Edgar Apolonio Aguilera, owner of the Yayika platform, RFC: AOAE781008V98 ("Owner", "we", "us", "our").
Continued use of the Platform following the posting of changes constitutes acceptance of such changes. We reserve the right to modify these Terms at any time, notifying users through the Platform or by email.
Yayika is a community platform designed for women entrepreneurs that offers:
Yayika is not a marketplace in the traditional sense. The platform operates under a community model where commercial transactions are managed directly between sellers and buyers, without Yayika intermediating in product payments.
To use Yayika, you must be at least 18 years of age. By registering, you represent and warrant that you meet this requirement. Yayika reserves the right to cancel accounts of underage users.

You are responsible for all activities that occur under your account, whether or not you have authorized them.
Yayika operates under a community model, not a traditional marketplace model. This means:
Digital products sold through vendors are the sole responsibility of those vendors. Yayika does not process, retain, or guarantee such transactions. The commercial relationship is directly between the seller and the buyer.
Yayika offers three membership tiers that grant access to different platform benefits:
Access to the general community, discussion forums, and public content. Ideal for women who are beginning their entrepreneurial journey.
Includes everything in the Basic plan plus access to specific courses, downloadable resources, group mentorships, and exclusive networking.
Includes everything in the Professional plan plus unlimited access to all courses, 1:1 mentorships, exclusive events, VIP community, and priority support.
Prices, specific benefits, and conditions for each plan are detailed in the plans section of yayika.com. Yayika reserves the right to modify plans, prices, and benefits with prior notice.
All membership payments are processed through Stripe, a secure PCI DSS Level 1 certified payment processor. Yayika does not store credit card data on its servers.

Yayika reserves the right to adjust membership prices. Users will be notified at least 30 days in advance of any price change. Continued use of the Platform following a price change constitutes acceptance of the new price.
Displayed prices may not include applicable taxes. The User is responsible for paying any taxes required by their jurisdiction.
Vendors offering digital products through Yayika accept the following obligations:
Yayika acts solely as a community space facilitator and is not a party to transactions between sellers and buyers.
By using Yayika, the User agrees to:
Violation of these rules may result in account suspension or deletion without prior notice and without right to refund.
All original content of the Platform, including text, graphics, logos, icons, images, clipart, data, and software, is the property of Edgar Apolonio Aguilera and is protected by Mexican and international intellectual property laws.
By posting content on Yayika, the user grants the Platform a non-exclusive, transferable, royalty-free license to use, reproduce, and distribute such content solely for the purpose of operating the Platform.
Course content (Ciclo Productiva, Dinero Sin Pena, La Mujer Que Negocia) is the intellectual property of Yayika and/or its instructors. Unauthorized reproduction, distribution, or sharing of this material is prohibited.
If you believe your intellectual property has been infringed, you may contact us at legal@yayika.com with the relevant information to investigate the claim.
To the maximum extent permitted by applicable law, Yayika and its Owner:
Yayika's total liability for claims related to the Platform will not exceed the amount paid by the User in the last 12 months.
The User agrees to indemnify, defend, and hold harmless Edgar Apolonio Aguilera, Yayika, and its affiliates, directors, employees, and agents from any claim, demand, damage, loss, liability, cost, or expense (including attorney fees) arising from:
Yayika reserves the right to suspend or terminate any user's account at any time and for any reason, including but not limited to:
In case of termination, the user will lose access to the Platform, community content, and membership benefits. No refunds are given for early termination.
This Agreement shall be governed by and construed in accordance with the laws of the United Mexican States (México), specifically the Federal Civil Code and the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to this Agreement, including the breach, termination, or invalidity thereof, shall be finally settled by binding arbitration administered by the International Centre for Dispute Resolution (ICDR) in accordance with its International Arbitration Rules. The arbitration shall be conducted in Spanish. The seat of arbitration shall be Mexico City, Mexico. The arbitral tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be Spanish. The arbitral award may be enforced in any court of competent jurisdiction.
To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Yayika agree that each has waived any right to a jury trial.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. This does not affect your mandatory consumer protection rights under applicable national legislation.
If you are a consumer in Brazil, you may also use the Consumer Protection Agencies (PROCON) and the judicial system of your domicile. This does not affect your rights under the Código de Defesa do Consumidor (CDC).
If you are a consumer in Argentina, you may also use the Dirección Nacional de Defensa del Consumidor or the judicial system of your domicile. This does not affect your rights under the Ley de Defensa del Consumidor No. 24.240.
If you are a consumer in Chile, you may also use the Servicio Nacional del Consumidor (SERNAC) or the judicial system of your domicile. This does not affect your rights under the Ley No. 19.496 sobre Protección de los Derechos de los Consumidores.
If you are a consumer in Colombia, you may also use the Superintendencia de Industria y Comercio (SIC) or the judicial system of your domicile. This does not affect your rights under the Ley Estatutaria 1755 de 2015 y el Código de Consumo.
If you are a consumer in Peru, you may also use the Indecopi or the judicial system of your domicile. This does not affect your rights under the Ley No. 29571 Código de Protección y Defensa del Consumidor.
If you are a consumer in Ecuador, you may also use the Superintendencia de Control del Poder de Mercado or the judicial system of your domicile. This does not affect your rights under the Ley Orgánica de Defensa del Consumidor.
Any claim arising out of or relating to this Agreement must be commenced within one (1) year after the cause of action accrues, or such cause of action is permanently barred.
